AFTER THE 42ND AMENDMENT ACT, 1976
This amendment removed all concerns concerning the President's standing under the Indian Constitution. It has changed Article 74 of the Constitution to state that the President is obliged by the advice of the Council of Ministers. "There should be a Council of Ministers, with the Prime Minister as its head, to aid and advise the President, who shall act in line with such advice in the performance of his powers," it states. According to the 42nd Amendment Act of the Constitution, the President could not even serve as an advisor or a guide.
