UTILITY OF DIRECTIVE PRINCIPLES

Despite the critiques and flaws mentioned above, the Directive Principles are not an extraneous addition to the Constitution. They are declared to be essential to the country's government by the Constitution. The Directives, according to L M Singhvi, a distinguished jurist and diplomat, "are the Constitution's life-giving provisions." They are the foundation of the Constitution and its social justice concept.'

Former Chief Justice of India M C Chagla believes that "if all of these principles are fully implemented, our country will truly be a heaven on earth." India would therefore be a welfare state that looked after its citizens' wellbeing as well as a democracy in the political sense.

The Directives, according to Dr. B R Ambedkar, are important because they establish that the purpose of Indian politics is 'economic democracy' rather than 'political democracy.'

The Directive Principles, according to Granville Austin, are "aimed at achieving the goals of the social revolution or to encourage this revolution by generating the conditions necessary for its attainment."

The Directive Principles are designed as "moral precepts for the authorities of the state," according to Sir B N Rau, the Constituent Assembly's constitutional advisor. They are at the very least educational.'

Although the Directive Principles do not bestow legal rights or offer legal remedies, they are significant and valuable in the following ways, according to MC Setalvad, India's former Attorney General:

  • They're similar to a 'Instrument of Instructions' or general recommendations addressed to all Indian Union authorities. They serve as a reminder of the fundamental principles of the new social and economic order that the Constitution seeks to establish.
  • They've functioned as helpful guiding lights for the courts. They have aided the courts in exercising their judicial review power, which allows them to examine a law's constitutional legality.
  • They set the tone for all state action, legislative or executive, and serve as a guide to the courts in various ways.
  • They augment the Preamble, which solemnly vows to secure justice, liberty, equality, and fraternity for all citizens of India.
